1.0 DEFINITIONS
1.1 “Accommodation”: Refers to the guest bedroom(s) designated for the Stay.
1.2 “Agreement”: The Reservation together with these Terms & Conditions.
1.3 “Arrival”: The earliest time check-in is permitted on the first day of the Stay, as specified on the Hotel’s official website or as agreed upon for early check-in.
1.4 “Client”, “you” or “your”: The individual responsible for organizing and paying for the Stay.
1.5 “Company”, “we”, “us” or “our”: The legal entity operating the Hotel.
1.6 “Guests”: Individuals accompanying the Client and attending the Hotel during the Stay.
1.7 “Hotel”: The Hotel property where the Client and/or Guests will stay.
1.8 “ENVI”: ENVI Boutique Hotel; a privately owned and operated establishment.
1.9 “Reservation”: The confirmed booking securing the Accommodation, including details such as room type, cost, arrival and departure dates, and any additional services (e.g., meals, drinks, gifts, or other items offered at the time of booking) (“Extras”) included in the Stay.
1.10 “Stay”: The period during which the Client and any accompanying Guests will visit the Hotel for the purpose of staying there.
2.0 THE AGREEMENT
2.1 By making a Reservation at ENVI Boutique Hotel, you confirm that you have read, understood, and fully accepted these Terms & Conditions.
2.2 Guests must be at least 18 years of age to make a Reservation and enter into the Agreement.
2.3 The Agreement becomes binding when your Reservation is confirmed by us, and you have completed payment for any required deposits or pre-payments outlined in your Reservation prior to Arrival.
2.4 Any changes to the Agreement, including variations requested by you, will only be valid if confirmed by us in writing (including email).
3.0 APPLICABLE TERMS
3.1 Only the Terms & Conditions outlined in this Agreement and specifically referenced in your Reservation confirmation will apply. Any additional terms you wish to include will not be valid unless expressly agreed upon in writing by us.
3.2 In the event of a conflict between the terms in your Reservation and these Terms & Conditions, the terms in the Reservation will take precedence.
3.3 We reserve the right to update our Terms & Conditions at any time. For this reason, we encourage you to review them prior to making a Reservation.
3.4 The Terms & Conditions that apply to your Reservation will be those in effect at the time you confirm your booking.
4.0 PAYMENTS
4.1 Payment for your entire Stay, including any Extras, must be made in full at the time of Reservation or upon arrival if not prepaid.
4.2 We accept payment via credit or debit cards. Please ensure your card’s expiration date extends beyond the end of your Stay. We also accept Cash, Apple Pay, Google Pay, Samsung Pay and Affirm Payments.
4.3 Personal checks are not accepted.
4.4 Business checks are accepted; however, they must be received at least three weeks prior to your Arrival to allow sufficient time for processing and clearance.
5.0 ADDITIONAL ROOM CHARGES
5.1 You are responsible for payment of any additional snacks, beverages, or packages not included in your Reservation but provided during your Stay, including those purchased in advance or during your visit (“Additional Items”).
6.0 EARLY CHECK-IN & LATE CHECK-OUT
6.1 Early check-in may be available based on availability and an additional fee. To guarantee early check-in, please request it in advance.
6.2 Late check-out may also be possible, subject to availability and an additional fee. We recommend making your request as early as possible, as availability can be limited.
6.3 If you or any Guests check out later than the agreed time without prior approval, we reserve the right to charge a fee of $20 per hour for late check-out.
7.0 PURPOSE OF THE ACCOMMODATION
7.1 The Accommodation is for the exclusive use of you and your registered Guests (if any).
7.2 The Accommodation is non-transferable and cannot be resold. If your plans change and you are unable to stay at the Hotel as originally booked, please cancel the Reservation in accordance with our Cancellation Policy outlined in Section 11.0.
8.0 CHILDREN
8.1 No individual under the age of 18 may occupy a guest room without being accompanied by a parent, guardian, or another responsible adult designated to act in loco parentis.
8.2 You are responsible for ensuring that you and any Guests under 18 can provide valid proof of age, such as a driver’s license, ID card, or passport.
9.0 FOOD & BEVERAGES
9.1 Enjoy our complimentary breakfast during your Stay, subject to any local or governmental restrictions in place at the time.
9.2 For your convenience and comfort, we kindly ask that you refrain from bringing outside wine, spirits, food, or beverages into the Hotel lobby for consumption.
10.0 ASSISTANCE DOGS & PETS
10.1 Assistance Dogs: We welcome Assistance Dogs during your Stay, with a limit of one Assistance Dog per guest bedroom unless both occupants require one.
10.2 Service Jackets: Assistance Dogs must wear the appropriate service jacket, ensuring our staff can easily identify them as working animals.
10.3 Pets: Our pet policy allows 2 pets (dogs only) per room with a nightly fee. Please check the Hotel’s official website before making a Reservation to confirm your pet in your reservation.
10.4 Pet Control: Pets allowed on the premises must be kept under control at all times. Dogs, for example, must remain on a lead unless inside your guest bedroom.
11.0 LOST PROPERTY
11.1 Check Before Departure: Please ensure you and your Guests have collected all belongings before check-out. The Hotel does not accept liability for lost items, and by accepting these Terms & Conditions, you agree that the Torts (Interference with Goods) Act 1977 does not apply to property left behind. The Hotel will not be considered an ‘involuntary bailee’ of any such items.
11.2 Reporting Lost Items: If you or your Guests leave property behind, contact us promptly by phone or email with a detailed description of the item(s), the date of your Stay, and the room number. If the item(s) are found, we can arrange for collection or shipping at your expense. Any under garments, illegal substance or firearms will be either disposed of or turned over to the proper authorities.
11.3 Unclaimed Items: Property left unclaimed for 30 days will be disposed of following current statutory requirements or donated to charity, as appropriate.
11.4 Claiming Items: If Items are found, we will set up a time for you to come collect the items.
12.0 CANCELLATION POLICY
12.1 Flexible Rate Reservations: If your Reservation is booked and you provide at least 24 hours’ notice prior to your scheduled Arrival, you may cancel your Reservation, and any deposit.
12.2 Non-Cancellable Rates: Reservations made under prepaid, non-cancellable rates are not eligible for cancellation or refunds under any circumstances.
12.3 Late Cancellations and No-Shows: Failure to provide the required cancellation notice or failing to arrive at the Hotel (“No-Show”) may result in charges for the first night Stay and all Extras as per the applicable rate rules.
12.4 First Night Charge for Late Cancellation: For fully flexible rate bookings canceled with less than 24 hours’ notice or in the event of a No-Show, you will be charged for the first night’s Accommodation along with any Extras that would have been provided during the first 24 hours of your Stay.
13.0 CONDUCT POLICY
13.1 Restricted Areas: Please ensure that you and your Guests do not access private or off-limits areas of the Hotel. The Hotel is not responsible for any injury, loss, or damage incurred in such areas.
13.2 Appropriate Behavior: All Guests are expected to conduct themselves respectfully. Any behavior or statements deemed defamatory, racist, threatening, or otherwise inappropriate by Hotel staff, or that could bring the Hotel into disrepute, will not be tolerated.
13.3 Prohibited Actions: For the comfort and safety of all, you and your Guests must refrain from:
- Smoking or using e-cigarettes in any area marked non-smoking.
- Bringing dangerous or hazardous items onto the property.
- Using electrical appliances such as toasters, mini cookers, or portable grills that may trigger fire alarms.
- Tampering with fire alarms or emergency equipment.
- Damaging or removing Hotel property, including furniture, fixtures, and fittings.
- Creating unreasonable noise or disturbances that affect other guests, Hotel staff, or neighbors.
13.4 Liability for Damages: As the individual making the Reservation, you are responsible for any damages or losses caused by you or your Guests to the Hotel, its staff, other guests, or their property. You will be required to cover the cost of any necessary repairs or replacements.
13.5 Right to Refuse or Cancel: The Hotel reserves the right to:
- Deny entry to any individual.
- Ask any Guest to leave the premises.
- Cancel the Stay immediately if necessary, at the Hotel’s sole discretion.
By adhering to these guidelines, we aim to ensure a pleasant and safe experience for all our guests.
14.0 HOTEL CANCELLATION POLICY
14.1 Reputation Protection: The Hotel reserves the right to cancel your Stay if, in our reasonable opinion, proceeding with the reservation could harm the Hotel’s reputation.
14.2 Financial Viability: We may cancel your Stay if we become aware of significant changes in your financial situation that lead us to reasonably believe you may not fulfill your obligations under the Agreement.
14.3 Hotel Cancellation Fees:
If the Hotel cancels your Stay within 24 hours of your planned Arrival, we may charge you for the first night’s Accommodation and any pre-booked Extras as a “Cancellation Charge.”
14.4 Cancellation Due to Misconduct: If your Stay is canceled due to behavior described in Section
the Hotel reserves the right to charge for all services provided up until cancellation. Additionally, we may impose a Cancellation Charge, Guest Compensation Disturbance fee and/ or Damage fee within 72 hours of your departure.
14.5 Refunds and Balances: If the Stay is canceled, any applicable charges or Cancellation Charges will be deducted from your deposit or pre-payments. If a balance remains after these deductions, you will still be responsible for covering it. Any surplus will be promptly refunded to you. By upholding this policy, we aim to maintain a safe, secure, and respectful environment for all guests while safeguarding the Hotel’s operations and reputation.
15.0 LIABILITY
15.1 Safe Custody of Valuables: The Hotel is not responsible for any loss or damage to your or your Guests’ valuable items.
15.2 Room Security: You and your Guests must ensure the guest bedroom door is securely closed and locked upon entry and exit. Do not rely solely on the door closer mechanism to ensure proper locking. The Hotel is not liable for any loss or damage to items resulting from failure to follow these precautions, as this would be considered negligence.
15.3 Public Areas Responsibility: All personal belongings must be kept secure in public areas of the Hotel. For example, leaving items unattended on a bar or table while stepping away is considered negligent. The Hotel is not responsible for any property left unsecured in such scenarios.
15.4 General Liability for Loss or Damage: The Hotel accepts no responsibility for the loss or damage of property belonging to you or your Guests unless required by the Hotel Proprietors Act 1956 (or, where applicable, the Local London Authorities Act 2004). Guests are encouraged to have adequate insurance coverage for their belongings during their Stay.
15.5 Exclusion of Liability: The Hotel will not be liable for:
- Increased costs or expenses.
- Loss of profit, business, contracts, revenue, or anticipated savings.
- Indirect, special, or consequential loss or damage arising from or in connection with your Stay.
15.6 Limitations of Liability: We do not limit or exclude our liability for matters where it is unlawful to do so.
15.7 Maximum Liability: If the Hotel is found liable, the maximum liability is limited to the total cost of your Stay. Where applicable, liability will adhere to the prescribed limits under the KRS 306.020 law.
15.8 Guest Insurance: It is your responsibility to ensure you and your guests have adequate insurance coverage for the duration of your Stay. By adhering to these policies, the Hotel ensures a safe and secure environment for all guests while clearly defining shared responsibilities.
16.0 GENERAL
16.1 Events Beyond Our Control The Hotel is not liable for any failure or delay in fulfilling obligations due to circumstances beyond our reasonable control. These include, but are not limited to, terrorist activities (actual or threatened), guest or third-party misconduct or negligence, war, political disturbances, riots, natural disasters, fire, epidemics, pandemics, government actions, industrial disputes, power or utility failures, and other similar events.
16.2 Alternative Accommodation: In unforeseen circumstances, we reserve the right to relocate your Stay to a comparable hotel at no additional cost. Should the alternative accommodation cost less than your original booking, we will promptly refund the difference.
16.3 Third-Party Services: We may use qualified third parties or subcontractors to deliver certain services or perform work at the Hotel on our behalf.
16.4 Data Protection: Your personal data will be handled with utmost care, in full compliance with the General Data Protection Regulation GDPR, ensuring your privacy and security throughout your Stay.16.5 Third-Party Rights. Except for ENVI Boutique Hotel, no third party has the right to enforce any part of the Agreement under the Contracts (Rights of Third Parties) Act 1999.
16.6 Consumer Rights: If you are a non-business customer, these Terms & Conditions do not affect your statutory consumer rights.
16.7 Entire Agreement: This Agreement constitutes the complete and exclusive understanding between the parties regarding the Stay. It supersedes any prior oral or written agreements, commitments, or representations.
16.8 Severability: If any provision of the Agreement is deemed invalid, unlawful, or unenforceable, the remaining provisions will remain in full effect. If necessary, the invalid provision will be modified or partially deleted to make it enforceable without affecting its intent.
16.9 Governing Law and Jurisdiction
The Agreement is governed by the CommonWealth Laws of Kentucky. Any disputes will be resolved exclusively in one of the three-tiered state court systems. Experience effortless hospitality where trust, transparency, and your satisfaction are our priorities.
